Events and Adventures Terms of Service

By using our Services, you are agreeing to these terms. Please read them carefully.

This section contains general guidelines and policies that you should know about the club, as well as things the club and other members should be able to expect from you. Our goal is to communicate a consistent set of expectations to everyone and eliminate misunderstandings and inconsistent interpretations. We want to provide an environment where everyone can have fun with a minimum of inconvenience or distraction.

Personal Information

Events and Adventures does not normally give your name, number, email, or address out to other clubs or organizations unless it is something like a customer service company to make sure we are taking good care of customers.

Events and Adventures may disclose the previously listed information in cases in which we have reason to believe that doing so is necessary to identify, contact, restrain, or bring legal action against someone who may be causing injury to or interference with Events and Adventures, our property, our users, or anyone else who could be harmed by such activities, and in cases in which we believe in good faith that the law requires us to do so.
Events and Adventures will not disclose any of your personal information, except when we have your permission or under special circumstances, such as when we believe in good faith that disclosure is reasonably necessary to cooperate with local, state and/or federal law enforcement authorities, to enforce the Terms of Use or prevent unauthorized use of the Application, to respond to claims that any content in the Events and Adventures Application violates the rights of third parties, or to protect the rights, property, or personal safety of Events and Adventures, its users, or the public.
Events and Adventures relies on feedback from users regarding the services provided. Events and Adventures reserves the right to replicate your written comments about the service sent to our representatives via our website or the Events and Adventures Application in promotional materials and/or in business development materials, along with your first name and institution. Your email address and any personal information besides your name and institution will not be used at any time without your agreement. If you would like to make your comments anonymous, you may designate them as such in your communication.

Events and Adventures uses email and text messages as well as phone calls and Facebook groups to communicate to members and prospective members information that is relevant to their membership, their events, or their membership application. You can stop this communication at any time (you will see in the text message or email how to do that).

If you want to contact another member, the best way is to get his or her phone number when you meet them at an event.

It is important that the club has an accurate address, home phone number, and an alternate phone number for you along with your email address. The email address is what gets your e-newsletter in your inbox Club staff often need to call members concerning details of upcoming events. If you move, be sure to call the office and update your records.
Users of the Events and Adventures Application may share links to other websites or materials posted online. Events and Adventures is not responsible for the content or privacy practices of those websites or any interactions you may experience while visiting said websites. We encourage our users to be aware when they leave our Site, and to read the policies of any site that they may visit. The Events and Adventures privacy statement applies solely to information collected by the Events and Adventures Application.Event Sign – Ups

  1. Be sure to keep a record of what you’ve signed up for!
  2. All events are filled on a “first paid, first reserved basis.
  3. Sign up early, if you can. This gives us time to increase our capacity if the demand is greater than expected.
  4. The event cancellation policy is on the website and may vary by event because of vendor deadlines, passport requirements etc.

For Application activities that request personal information, you agree to provide accurate and current information about yourself. Your registration and/or participation in our Application services may be canceled without notice if at any time we discover that you have provided false information or violated any term of this Privacy Policy or our Terms of Use.

SECURITY

We take every precaution to protect your information. When you submit information via the Events and Adventures Application, your information is protected both online and offline. Online, we use encryption and smart server architecture to protect information. While we strive to protect your privacy and secure your information, we cannot guarantee the security of information sent via your personal Internet connection, and you disclose such information at your own risk.
Only Events and Adventures employees with a specific need to access your information in order to perform their job duties are provided such access to the data you provide, and they must have secure administrative rights in order to do so. The servers on which personally identifiable information is stored are kept in a restricted, secure environment, and are professionally maintained.

AGREEMENT

By using the Events and Adventures Application, you signify your consent to our Terms of Use. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Use at any time without further notice. If we do this, we will post the changes to these Terms of Use on this page and will indicate at the top of this page the Terms of Use’s effective date. Your continued use of Events and Adventures after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to abide by these or any future Terms of Use, please do not use or access Events and Adventures. It is your responsibility to regularly review these Terms of Use.
You agree that you may not use Events and Adventures in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Events and Adventures Application. In addition, you agree not to use the Events and Adventures Application to:

  • upload, post, email, transmit or otherwise make available any content that we deem to be harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, pornographic, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
  • impersonate any person or entity, create a false identity, or falsely state or otherwise misrepresent yourself or your affiliation with any person or entity;
  • upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation;
  • upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  • intimidate, stalk or harass another person or entity;
  • harm minors in any way;
  • use or attempt to use another’s account, service or system without authorization from the Company;
  • forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the Events and Adventures Application;
  • upload, post, email, transmit or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
  • in any way violate any honor code or code of conduct of Events and Adventures;
  • aid or encourage a student to violate the honor code or code of conduct of the institution to which a student belongs;
  • use Events and Adventures as a marketplace for any services without the written approval of the management of Events and Adventures

Your use of the Events and Adventures is at your sole risk unless otherwise explicitly stated. The Application and Events and Adventures Website (www.Events and Adventures.com), including the information, services, and content, is provided on an “as is”, “as available”, and “with all faults” basis. Events and Adventures disclaims all express or implied conditions, representations, and warranties of any kind, including any implied warranty or condition of merchantability, satisfactory quality, or fitness for a particular purpose. Events and Adventures makes no representations, warranties, conditions or guarantees as to the usefulness, quality, suitability, truth, accuracy, or completeness of the Application or the Services provided by a tutor met with using the application.

Events and Adventures makes no warranty or representations that the Events and Adventures Application will be uninterrupted, timely, secure, or error-free; the results that may be obtained from the use of the Application will be accurate or reliable; the quality of any services, content, information obtained through the Events and Adventures Application will meet your expectations or requirements; or any errors in the Events and Adventures Application will be corrected.
You assume all risk for any damage to your computer system or loss of data that results from obtaining any content from the Events and Adventures Application, including any damages resulting from computer viruses.

INDEMNITY

You agree to indemnify and hold Events and Adventures and its subsidiaries, affiliates, shareholders, officers, directors, agents, licensors, suppliers, alliance members, other partners, employees, and representatives harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of or connection to the Events and Adventures Application or the Events and Adventures website (including any use by you on behalf of another party), your violation of the Terms, or your violation of any rights of another person or entity.

DISCLAIMER

Events and Adventures will not be involved in any tutor-student interactions in any subject. Events and Adventures is not responsible for disputes, claims, loss, injury, or damage of ANY KIND that might arise during and after tutor- tutee interaction. We reserve the right, but have no obligation, to monitor interactions and/or disputes between tutor and tutees.

The Events and Adventures Application is provided on an “AS IS” basis and Events and Adventures disclaims all responsibility for any loss, liability, injury, claim, or damage of any kind resulting from any errors in the Application and its content including, but not limited to, typographical and technical errors and inaccuracies.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Events and Adventures is not liable for any direct, indirect, punitive, special, incidental, consequential, or exemplary damages (including, without limitation, loss of business, revenue, profits, goodwill, use, data, electronically transmitted orders, or other economic advantage) arising out of or in connection with the Events and Adventures Application, even if Events and Adventures has previously been advised of, or reasonably could have foreseen, the possibility of such damages, however they arise, whether in breach of contract or in tort (including negligence), including without limitation damages due to: the use of or the inability to use the Events and Adventures website or Application; the cost or procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained, or messages received or transactions entered into, through or from the Events and Adventures website or Application; statements or conduct of any third party on the Events and Adventures website or Application, including, without limitation, unauthorized access to or alteration of transmission or data, malicious or criminal behavior, or false or fraudulent transactions; or content or information you may download, use, modify, or distribute.

This website and the Events and Adventures Application are owned and operated by Tutor Matching Service LLC. The contents of this website including, but not limited to, the database information are protected by copyright laws and regulations. No material in any shape or form may be copied, reproduced, transmitted, or distributed.

Guests

Events and Adventures is a private club, and of course, leaving the events totally open to non-members defeats the purpose of the organization. We do recognize, however, that friends and relatives do drop in from time to time, and might like to see what we are all about. You are welcome to bring guests to events you attend with the following stipulations:

To be fair to paying members, non-member guests may attend a maximum of two events. If they want to become regulars, they should join the club. We have a strong member referral program, call the office for details. Your friends will normally get a discount just for being your friend! Ex-members cannot come as guests unless the club specifically opens an event to Ex-members (after all – ex members already know about the club and have no reason to come as guests, they should renew!).

Call the office ahead of time to let them know you want to bring a guest. On events with a limited number of spaces, regular members will get priority. For safety reasons, the club must have each guest’s name and a contact phone number in case of emergency. They must also sign a waiver when they sign in for the event, as well as the sign in waiver at the event itself. If the event is not free, your guest, of course, needs to pay the cost, sometimes we charge more for guests.

You, as the host, are responsible for the behavior of your guest(s). It is best to only bring one guest at a time.

If your guest is interested in joining, please refer them to the club for an interview.

Pets

Although many members have pets, allergies, health laws, facility restrictions, differing feelings toward animals, and potential liabilities prevent us from allowing pets at most events. If pets are welcome at a specific event, it will be stated in the event description.

If pets are allowed, and you bring yours, you are responsible for keeping it under control. Please be respectful of other people’s feelings and possible discomfort with animals.

If you have a “Service Animal” as deemed a “Service Animal” by State, Federal (or in the case of Canada Providential) law. Events & Adventures will of course allow this animal at events to the full range that the law allows.

Children

Many Events and Adventures members have children and we fully understand that those children are a significant part of those members’ lives. Many other Events and Adventures members do not have children, and as a general rule, children are not allowed at most events. If there is an exception, the event will be designated as “kids” event, where children are welcome. Note that this does not mean you can drop your kids off at the event. You must be present and are responsible for your children in every way. Babysitters are not provided. Guests who are over 18 but under 21 are allowed, but you must check with the office first to make sure that state alcohol laws won’t keep them from being a part of the event because of the location we are meeting etc. If alcohol is available at that event that they are allowed to attend (such as a camp out), we expect them to comply with the law and not indulge. Doing otherwise would jeopardize the club legally. As with all events you accept personal responsibility for your guest, their actions, and anything that might happen to them, when you sign them up for the event.

Alcohol

We are all adults. Each of us is expected to act responsibly and be considerate of other members. Although the club does not provide alcoholic beverages, there are many events where you are welcome to bring or buy them. All we ask is that you know your own limit for the situation. Make sure you have your own transportation arranged in case you can’t drive yourself home. If you cross the line, expect to be dealt with accordingly. Depending on the severity of the incident, you may find your membership suspended or even revoked.

Tobacco

There are smokers in the club, but they are a minority. Many are so considerate about it that it was some time before they were “discovered.” If we are in a smoke-filled dance club, please abide the rules of the establishment. At other locations, however, ESPECIALLY in other members’ homes, we ask that you step outside and away from the crowd before lighting up. We rarely receive a complaint because of smoking, and would like to keep it that way.

Firearms

Unless an event is geared specifically to a shooting sport, leave your guns at home. There are no exceptions to this rule.

Drugs

Don’t bring illegal drugs to events, period. Anyone who is found to have drugs in their possession at any time or under the influence of drugs will be expelled from the club immediately and without a refund of any kind. There will be absolutely no exceptions.
